Article-2: Employer’s Obligations and Powers in terms of Insurance under JCT IC 2011

The employer has various powers and duties with respect to insuring works under the express provisions of the JCT Intermediate Contract. Under schedule 1 para C.2, the employer has the duty to take out and maintain a policy in the joint names for all risks for the works. The employer has to produce documentary evidence of insurance and receipts for the premier payments, as and when reasonably required by the contractor (schedule 1 para C.3.1.1).

Employer also has to take out and maintain joint names policy for all risks for New Building (schedule 1 para B.1) and has to produce documentary evidence of insurance and receipts for premium payment, as and when reasonably required by the contractor (schedule 1 para B.2.1.1). The employer has the power to approve the insurers, in regards to insurance against all risks for new building by the contractor (schedule 1 para A.1) and can take out the insurance, if the contractor fails to insure against all risks for new building (schedule 1 para A.2).
It is the employer’s duty to take out and maintain joint names policy for existing structures (schedule 1 para C.1), just as for works and new buildings.

Employer can inspect the policy and premier receipts for all risks insurance in joint names at all reasonable times (schedule 1 para A.3). The employer has to pay insurance monies to the contractor by installments under architect’s certificate; less only amounts in respect of professional fees (schedule 1 para A.4.5). An employer can retain amount properly incurred in respect of professional fees from monies paid by the insurers (schedule 1 para A.4.5).

Employer has the power to use or occupy the site or works, with the contractor’s written consent before practical completion, and to this effect the contractor’s consent must not be unreasonably delayed or withheld. The employer has the duty to notify the insurers, under insurance options A,B or C, and get confirmation that such use or occupation will not prejudice existing insurance (clause 2.6).

Under clause 6.4.2, the employer has the power to require the contractor to send documentary evidence of insurance to the architect and it must be exercised reasonably. Employer can also require that relevant policies are sent to the architect at any time but not unreasonably or vexatiously. If the contractor fails to insure against personal injury or death or injury to property, the employer has the power to insure and deduct premium amounts from monies due to the contractor or recover them as a debt (clause 6.4.3).
Terrorism Cover
Where the employer is the local authority; under Schedule 1 pare C.3.2, the employer has to produce copy of cover certificate regarding terrorism cover, as and when reasonably required by the contractor. An employer can instruct the contractor not to renew terrorism cover under the joint names policy, where the employer is a local authority, in lieu of adjusting the contract sum (schedule 1 para A.5.2). It is the employer’s duty to inform the contractor, if the insurers named in joint names policy notify that terrorism cover will no longer be available (clause 6.10.1). If the employer receives notification from the insurers that terrorism cover will cease, then the employer has to give written notice to the contractor that either the works must be carried out, or the contractor’s employment will terminate on the date stated in the notice (clause 6.10.2).
Fire Code
The employer has to ensure compliance with joint fire code of all employers’ person (clause 6.12); and has to send copies of notice to contractor and architect if breach of joint fire code occurs, and insurers notify the employer of any remedial measures required.
